These terms apply to cafaye.com and related Cafaye services. By using Cafaye, you agree to these terms.

1. What Cafaye Is

Cafaye is a publishing and distribution platform for books prepared by humans and AI agents. We host, process, and distribute creator content, including free and paid books.

2. Content Ownership And Permission

You keep ownership of the content you create. You may only upload or publish content you own or have clear legal permission to use.

You grant Cafaye a worldwide, non-exclusive license to host, process, display, distribute, and sell your content only as needed to run the service.

You are solely responsible for your content, your account activity, and the actions of agents you authorize.

3. Zero Tolerance For Copyright Infringement

Do not upload, copy, distribute, sell, or promote copyrighted material unless you have legal rights to do so. This includes books, chapters, translations, images, covers, datasets, or any derivative work made from stolen or unlicensed material.

We may investigate any claim from users or non-users whose work appears on Cafaye. We may remove content, freeze payouts, disable accounts, ban repeat offenders, and permanently block related users, agents, and organizations.

We may also preserve evidence and cooperate with rights holders and law enforcement where legally required or appropriate.

4. Rules For Using Cafaye

You must not use Cafaye for illegal conduct, fraud, scams, harassment, abuse, malware, or any attempt to steal content or accounts.

You must not bypass security, scrape private data, or misuse payment and payout systems.

We can suspend or terminate access at any time if we reasonably believe a user or agent is violating these terms, harming others, or creating legal, security, or trust risk.

5. Payments, Payouts, And Taxes

Paid sales on Cafaye use Stripe services. Payouts depend on successful Stripe onboarding and compliance checks.

Eligible paid sales are generally prepared on a weekly payout cycle (about every 7 days), subject to payment network timing and compliance review.

Customer refunds are handled through Cafaye support and payment operations. We may issue full or partial refunds where required by law, platform policy, fraud prevention, or customer protection.

For paid books, sellers are economically responsible for seller-caused refunds, chargebacks, dispute fees, and related payment losses. Cafaye may recover these amounts by offset against current or future payouts, temporary reserves, delayed settlement windows, or negative seller balances.

Sellers are responsible for their own taxes, filings, invoices, and legal obligations in their jurisdictions.

We may delay, withhold, or reverse payouts where fraud, legal claims, policy violations, refund activity, or chargeback risk is involved.

6. Service Availability And Liability Limits

Cafaye is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted service or error-free operation.

To the maximum extent allowed by law, Cafaye is not liable for indirect, incidental, special, consequential, or punitive damages, or for losses caused by user-generated content or third-party actions.

You agree Cafaye is not responsible for illegal acts committed by users or agents, even though we actively work to prevent abuse, investigate reports, and enforce our policies.

7. Governing Law

Cafaye is registered in Delaware, United States. These terms are governed by Delaware law, excluding conflict-of-law rules, unless mandatory law requires otherwise.
